Terms and Conditions for
BEAR Competition

1. Competition Name and Organiser

1.1 The BEAR Father’s Day - Give a Dad a Beak Competition ("Competition") is organised by Tuffsan Investments 1091 (Pty) Ltd, a company registered in South Africa, with its office at Le Val 45 Jan Smuts Avenue Westcliff Johannesburg 2193 (the "Organiser").

2. Competition Period
2.1 The Competition will run from Sun,15 June 2025 to Friday, 20 June 2025, both days inclusive (“Competition Period”).

3. Eligibility
3.1 The Competition is open to all residents of South Africa who are aged 18 years or older as of the date of entry (“Participants”).
3.2 The following individuals are not eligible to participate:

  • Employees, directors, and officers of the Organiser and their immediate family members.

  • Individuals who are prohibited by law from entering competitions.

  • Employees, directors, and officers of Style Eyes Of California (Pty) Ltd and their

immediate family members.

4. How to Enter
4.1 To enter the Competition, Participants must, during the Competition Period:

• follow BEAR social media account/s;

• follow the instructions on the call to action.
4.2 Each Participant may enter the Competition only once.
4.3 Participants must ensure that all details provided are accurate. Incomplete, incorrect, or fraudulent entries will be disqualified.
4.4 Participants who complete the process in 4.1 above shall be Eligible Persons who stand a chance to win a prize.

5. Prize
5.1 There will be a minimum of four and a maximum of ten winners (“Winners”) selected from Eligible Persons. The Winner(s) will receive the following prize(s) (“Prize”):

• A gift package that shall include BEAR underwear.

  1. 5.2  The approximate value of each Prize is R500.

  2. 5.3  The prize is non-transferable and cannot be exchanged for cash or any alternative.

  3. 5.4  Delivery will be arranged by the Organiser, in South Africa only.

6. Winner Selection and Notification
6.1 The Winner(s) will be selected from Eligible Persons via panel judging.
6.2 The Winner(s) will be notified by social media within 10 days of the end of the Competition Period.
6.3 If the Winner(s) do not respond within 5 calendar days from notification, the Organiser reserves the right to select an alternate Winner.
6.4 The Winner(s) will be required to verify their identity and eligibility, and may be asked to provide proof of age and/or residence.

7. Publicity
7.1 By entering this Competition, Eligible Persons agree that the Organiser may use their name, image, likeness, and other details for promotional and marketing purposes of the Organiser and its products, without additional compensation, except where prohibited by law.
7.2 The Winner(s) will be required to photograph and video themselves opening the Prize and wearing the Prize, and must share these images with the Organiser, who shall be entitled to use the images for all promotional purposes associated with the Organiser’s business.

8. Personal Data
8.1 By entering this Competition, participants consent to the processing of their personal data in accordance with the Protection of Personal Information Act (POPIA).
8.2 Personal data will be used solely for the purposes of administering the Competition and delivering the Prize.

9. Disqualification
9.1 The Organiser reserves the right to disqualify any Eligible Person who:

• Provides false or misleading information.
• Fails to comply with these Terms.
• Engages in any form of unlawful or unethical conduct.

9.2 If disqualified, a Winner will forfeit any claim to a Prize, and the Organiser may select an alternate Winner.

10. Liability
10.1 The Organiser is not responsible for any technical issues, system failures, delays, or any errors that may affect the entry process or the Competition results.
10.2 The Organiser is not responsible for any damage, loss, or injury that may occur as a result of entering the Competition or accepting and using the Prize, except where required by law.
10.3 The Organiser’s liability is limited to the value of the Prize(s) offered.

11. Force Majeure
11.1 The Organiser shall not be liable for failure to fulfil any aspect of the Competition or award the Prize(s) due to circumstances beyond its reasonable control, such as events of force majeure, natural disasters, or government restrictions.

12. Governing Law
12.1 These Terms are governed by the laws of the Republic of South Africa.
12.2 Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.

13. General Terms

13.2 The Organiser reserves the right to modify, suspend, or cancel this Competition at any time, for any reason, without prior notice. Any changes to these Terms will become

effective when the updated Terms are made available on the Organiser’s website. Participants undertake to regularly check the website for any updates or changes to these Terms.
13.3 The Organiser’s decision on all matters regarding this Competition is final and no correspondence will be entered into.
